Description

A Raleigh County woman is suing over claims Kmart pharmacy employees violated HIPAA by discussing her medical information in the store. Struggling Sears Holdings To Announce Q3 EarningsLeslie J. Pettry filed a lawsuit April 14 in Raleigh Circuit Court against Kmart Promotions LLC, citing negligence. According to the complaint, Pettry was a customer of Kmarts pharmacy department in their Beckley store on Aug. 5, 2012, when an employee of Kmart openly discussed her medical information in the crowded store. The defendant is accused of violating the Health Insurance Portability and Accountability Act by allowing Pettrys confidential medical information to be disseminated to the public. Pettry is seeking damages in an amount to be determined by the court. She is being represented in the case by attorney Anthony M. Salvatore of Hewitt & Salvatore PLLC. The case has been assigned to Circuit Judge H. L. Kirkpatrick.
